Terms of Service

1. General provisions

These Terms of Service govern the use of the mobile application and websites operated under the CosyCamp brand (the “App” or the “Service”), which connect parents and legal guardians with operators of children's camps, summer activities and similar programmes.

The Service is operated by the entity identified in the Privacy Policy (the “Operator”). Full registration details are published in the Privacy Policy.

2. Definitions

  • Parent / Guardian (Buyer) — an adult with full legal capacity who enrols a child in a camp or activity.
  • Operator-camp / Seller — a business operating children's camps, colonies or activities.
  • Participant (Child) — a minor enrolled in a camp by a Parent / Guardian.
  • Agreement Card — an electronic summary of the terms of participation (dates, price, packing list, medical care, transport).
  • Reservation — a commitment to deliver the camp / activity that arises after acceptance of an Agreement Card.
  • Payment Operator — Stripe Payments Europe, Ltd. or a Stripe group entity.

3. Technical requirements

  • a device running iOS (latest and one previous major version) or Android (minimum version listed in the store),
  • an active Internet connection,
  • an active email account.

4. User account

  1. Only adults may create an account in the App.
  2. Authentication is provided by Clerk and is available via email/password or Google or Apple sign-in.
  3. Operator-camp and Parent / Guardian accounts are separate.
  4. The User may delete the account at any time. The consequences of deletion are described in the Privacy Policy.

5. Scope of services

  • browsing camp and activity offers,
  • enrolment of a child with sharing of information necessary for a safe stay (medical notes, emergency contact — only data provided voluntarily by the Parent / Guardian),
  • 1:1 chat (Parent–Operator-camp) for organisational matters,
  • negotiations and the Agreement Card,
  • reservations and payments handled exclusively by the Payment Operator,
  • notifications about dates, packing lists and important updates.

The Operator does not provide camp services on its own. The Parent / Guardian and the Operator-camp are always the parties to the underlying contract.

6. Parental responsibility

  1. The Parent / Guardian declares they are entitled to represent the child and to decide on the child's participation.
  2. The Parent / Guardian is responsible for the accuracy and completeness of data provided to the Operator-camp, in particular medical and contact details.
  3. The App does not create accounts for children and does not enable children to use the App on their own.

7. Payments

  1. All payments are processed by the Payment Operator (Stripe). The App does not collect, store or process full payment-card data.
  2. Payment method selection (card, Apple Pay, Google Pay, Klarna) takes place in Stripe's secure form.
  3. Payment may be made in full or in stages (deposit and balance) as defined in the Agreement Card.
  4. Failure to pay the deposit or balance on time results in automatic cancellation of the Reservation, without further claims against the Operator-camp.
  5. In the current MVP version of the Service, no automated refund mechanism is provided. Cancellations, rescheduling and refunds are arranged directly between Parent / Guardian and Operator-camp via chat and executed outside the Service.
  6. Settlement currencies are PLN or EUR.
  7. The Operator charges Operator-camps a commission on completed transactions, agreed individually.

8. User obligations

  • use the App in accordance with applicable law and good practice,
  • do not share login credentials,
  • do not post unlawful, offensive or infringing content,
  • do not scrape data or attempt to bypass security measures.

9. Complaints

Complaints regarding the App may be sent to [email protected]. The Operator handles complaints within 14 days of receipt. Complaints regarding the quality or delivery of a specific camp should first be addressed to the Operator-camp.

10. Liability

  1. The Operator endeavours to keep the Service running continuously. The Operator is not liable for downtime caused by force majeure, third-party action or required maintenance.
  2. The Operator is not a party to the contract between Parent / Guardian and Operator-camp and is not responsible for its performance, in particular for the organisation, supervision and safety during a camp.
  3. To the extent permitted by law, the Operator's liability is limited to damages caused by wilful misconduct.

11. Consumer right of withdrawal

A consumer has the right to withdraw from the electronic-services agreement with the Operator within 14 days of its conclusion, without giving any reason, by sending a notice to [email protected]. The right of withdrawal does not apply to individual services ordered from an Operator-camp whose performance has begun, with the consumer's consent, before the withdrawal period ends.

12. Personal data

Processing of personal data — including data concerning children, which is afforded special protection by the GDPR — is described in the Privacy Policy.

13. Changes

The Operator may amend these Terms for valid reasons. Users are notified of material changes at least 14 days in advance via the App or by email.

14. Governing law and disputes

These Terms are governed by Polish law. The parties shall seek to resolve disputes amicably. Consumers may use the European Commission's ODR platform at ec.europa.eu/consumers/odr.
